Brief description

This module is only available to students registered on the PGDip Legal Practice (LPC).

This module enables students to advise and assist clients in the field of Family Law. The module will be delivered in an interactive manner and the students will be taken through both a Family Law action step by step. They will be trained to understand the particular needs of clients in this area, the need for human awareness and the importance of helping the client to accept the desirability of settlement and ADR. Emphasis will be placed on the awareness of the needs of children, the provisions for public funding and other means of financing action.

Content

1. Introduction to family and child law and the role of the family law solicitor. Introduction to the course and teaching method. Initial interview with client.

2. Financial Matters. Advising on public funding and costs, initial advice on divorce procedure, ancillary relief, the position of the children of the family and mediation. Preparation and filing of court documentation.
Advising on and negotiating financial arrangements. Protection of the matrimonial home, advising on division of capital and income, calculation of child support payments. Pre-application protocol, negotiation and settlement.

3. Preparation for ancillary relief application. Drafting affidavit and supporting documentation. Statement of issues and preparation for hearing.

4. Application for ancillary relief before a district judge, drafting consent order and advising client.

5. Advice on statement of arrangements for the children. Introduction of domestic violence issue. Emergency steps. Advice to client, drafting of documentation for application for domestic violence injunction.
