UCATT Procedure Agreement
Procedure Agreement between the University of Wales Aberystwyth and UCATT
- The purpose of this agreement is to provide machinery for negotiation and consultation between the University of Wales, Aberystwyth and the Union of Construction, Allied Trades and Technicians (UCATT) in respect of all grades of craftsmen/women employed by the University.
- All questions of salaries and conditions of service shall be covered by this machinery other than those negotiated nationally between UCATT and the Universities and Colleges Employers Association, hereafter referred to as "UCEA". The application of any such agreement and any matter arising therefrom shall be covered by this procedure. The agreement reserves for the University the normal rights of the employer with regard to the appointment, remuneration and promotion of individual craftsmen/women.
- Individual issues within the terms of paragraph 2 above shall in the first instance be raised by the individual with his/her line manager, and then with the Director of Estates, accompanied, if desired, by a Trade Union Representative.
- Collective issues may be raised by UCATT with the Director of Estates, and for this purpose the they shall nominate one person to represent the interests of their members
- Failing settlement under paragraph 4 the issue may be raised by the nominated Trade Union Representative with the University administration.
- If, after the procedures outlined above have been exhausted and settlement has not been reached, the University and UCATT will either meet within 14 days to consider the possible use of the available local conciliation machinery (e.g. the services of the Department of Employment), or mutually agree to use the machinery of the Central Council as set out below.
- If an issue under (3) and (4) above is not resolved after the exhaustion of all local procedures, it may be referred to the Joint Secretaries of the Joint Committee for Manual and Ancillary Staff of the Central Council for Non-Teaching Staffs in Universities and, if both parties agree, to arbitration following the reference to the appropriate Joint Committee.
- No stoppage of work, either of a partial or general character, shall commence until all the procedures specified have been carried out.
- Adequate facilities shall be given to the nominated Trade Union Representatives for them to contact staff who wish to seek advice on matters concerning their employment. Representatives wishing to leave their place of work during normal working hours for this purpose shall obtain prior permission from the Director of Estates or his/her nominee: such permission will not be unreasonably withheld.
- Suitably sited notice boards shall be placed at the disposal of UCATT in order to display literature acceptable to the University.
- Accommodation shall be made available to enable bone fide union meetings to be held outside normal working hours.
- This agreement is without prejudice to the rights of any individual employee to raise with the University any matter affecting him/her.
- This agreement took effect from 1 May 1977. Its terms may be reviewed if three months written notice is given. If either party wishes to vary terms, or terminate this agreement, three months written notice should be given.
- All parties accept that this agreement is binding in honour upon them, but all expressly agree that it is not intended to constitute a legally enforceable agreement between them.
