Learning Outcomes

On completion of this module, students should be able to:
1. Demonstrate a detailed knowledge and understanding of the theoretical basis of competition law.
2. Demonstrate a detailed knowledge and understanding of the development of the European Union¿s Competition law regime.
3. Explain and critically comment upon the theoretical and practical operation of the European Community¿s system of competition law.
4. Evaluate the effect of competition law upon the regulation of European commercial business activities.
5. Display an ability to gain access to the relevant literature and materials in this field and how to use them to engage in a critical discussion of the subject.

Brief description

Academic Rationale:
This module will enable students to begin the study of European competition law at a postgraduate level via the medium of distance learning. Such a course of study will allow the student the opportunity of developing and diversifying their existing commercial experience into the legal regulation of competition in Europe. This module provides an introduction to a modern and important area of commercial regulation.

Brief Description:
This module will begin by introducing the theoretical aspects of Competition Law such as the concepts of 'market' and 'perfect' / 'imperfect' competition and various 'schools' of economic thought concerning competitive regulation. It will then proceed to introduce the European legislation by which the law has been developed and enforced in the course of attempting to regulate commercial competition within the European Union.

Content:
1. Introduction to the economic theories underlying the legal regulation of competition.
2. Introduction to the primary and secondary European Legislation which concerns Competition Law.
3. From Article 85EEC to Article 81EC - the development of the European anti-cartel provision.
4. From Article 86EEC to Article 82 EC - the development of the European anti-monopoly provision.
5. The refinement of the European Commission's enforcement role.
