Learning Outcomes

On completion of this module, students should be able to:
1. Demonstrate sound knowledge of the historical context of the development of environmental law and policy in the UK and some of the drivers and challenges of regulation.
2. Critically evaluate the competing regulatory approaches and mechanisms including their strengths and limitations in light of regulatory environment
3. Develop an in-depth understanding of the processes and mechanisms for redress
4. Engage in a critical discussion of key sectoral regulation, including the drivers of the policy approaches adopted and the effectiveness or otherwise of these approaches.
5. Demonstrate ability to effective engage with relevant literature and materials, and effectively communicate the acquired knowledge acquired in a reflective and balanced manner.


Brief description

The aims of this module are two-fold. First, this module covers the UK laws that relate to pollution across the media of air and water, including the relevant statutory provisions and case-law, and government policy initiatives and national strategies. The administrative bodies responsible for implementation and enforcement of the legislation are highlighted, concentrating on their investigative and enforcement roles and duties. Second, this module examines the effectiveness of reactive legal measures, such as civil liability, to control pollution as well as the role of public participation and access to information concerning the environment. There is also a detailed examination of the use of economic instruments in pollution control; this is an area of pollution law that is becoming more important, with the current fashion for the use of economic instruments in every sector of society.
